  • I don’t know why you’re getting downvoted, this is the real reason.

In the wake of 9/11, Congress issued a broad, many would say overly broad, Authorization for the Use of Military Force that basically granted the Office of the President open-ended permission for any conceivable martial escapade he might want in the Middle East. Every President of the 21st century has used this as the legal justification for meting destruction onto that part of the world: for the wars in Iraq and Afghanistan, bombings in Syria, Libya, Somalia, Yemen, and Pakistan, as well as our little-publicized offensive in Northeast Africa.

Due to this, what Trump did is legal. Unfortunately it seems people just want to shoot the messenger now if they say something they disagree with, even if they’re correct.

I 100% support removing Trump from power through impeachment and absolutely think he’s a threat to democracy, but throwing bullshit articles of impeachment at him over and over just galvanizes his base when he continually shrugs them off.

  • Voting is a right, not a privilege. Adding $50 here and $30 there every time something happens removes the right and makes it something only people with money can do. Are you being intentionally dense here? If it cost $0 and took no time I could understand your point, but it takes both money and time. IDs aren’t free, passports aren’t either, updating birth certificates also isn’t free, and in many cases it has to be done in person with multiple forms of additional documentation which also takes time, effort and money to procure.

Last but not least, in its current form the people who will be impacted by it are two groups of people and one financial class of person, primarily – women and transgender who changed their name from their birth name, and people who don’t have the money to update their ID, get a passport, or pay to have their birth certificate updated. So, it’s not even effective at what it is trying to do, it’s only effective at making sure it’s harder for women, trans people who have changed their names, and poor people to vote. All three groups who historically tend to lean democrat with their votes – who would have guessed.

Rich white men will never have a problem, miraculously. If what you’re trying to say is you’re OK if it’s harder for women and trans people and poor people to vote, then just come out and say it, otherwise you need to realize that this voting bill does that and only that and re-think your position.

  • The problem is that the DMCA is a flawed piece of legislature that hamstrings fair use in a couple of really key ways.

Obligatory IANAL, but my read on the (admittedly very legalese) section 1201 (https://www.law.cornell.edu/uscode/text/17/1201) is that it lists a very few exemptions for what is allowable under the DMCA with regard to bypassing copyright protection mechanisms, and archival copies of personal media are not in that list of exemptions. Archival use of computer programs is covered under section 117 (https://www.law.cornell.edu/uscode/text/17/117) and it allows you to make a bit-by-bit copy of your media for archiving it. It doesn’t allow you to bypass copyright protection mechanisms that exist on that content.

So, you’d be protected if you were making a 1:1 exact cloned (and therefore, encrypted) copy of your switch game. Any action to decrypt that switch game (because the encryption is explicitly a copyright protection mechanism) would be a violation, whether it be you doing it manually with a tool, or an emulator doing it on your behalf. If you move that violation outside of the emulator, I would think that based on how the law is written they’d have to find some other way you were violating the DMCA with the emulator specifically in order to target it.

Ultimately, I think the reason it’s illegal is because the DMCA is corpo crap that has been bastardized several times over to reduce consumer rights, but the lawyers seem to wield section 1201 as the silver bullet.

  • Emulation is legal but emulators that circumvent the DMCA in order to function are not. Yuzu and Ryujinx both decrypt encrypted Switch content using prod keys and title keys in order to execute it. The act of decrypting switch games in real-time using those keys is a violation of DMCA and is illegal (in countries that care about the DMCA anyhow). Having code in your emulator that CAN decrypt the Switch content can be viewed as a DMCA violation as well, even if it also supports unencrypted content.

Based on that, it seems like all we need is for Ryujinx/Yuzu/some other switch emulator that hasn’t yet been sued by Nintendo to be built in a way that it requires decrypted copies of the software and they could then argue that the person who violated the DMCA was the person who released the decryption tool or the teams that release decrypted versions of switch software.

Seems like if the developers remove the need for the emulator to use prod keys or title keys and they can remove the primary DMCA violation that is being weaponized against these emulators.

  • I want it treated like every other murder in New York. I want the police to spend 5 minutes pretending to look for the perpetrator, shrug their shoulders, say “nothing could be done, thoughts and prayers”, then throw this into the perpetually growing pile of unsolved murders and move on with their day.

That’s what they do when anyone else in the city or state is murdered, this guy doesn’t deserve special attention. If they want to solve murders they should solve every murder, not just the billionaire’s murder.

  • It wouldn’t be much, but I still hope Harris wins the popular vote – even though I think she was a fucking garbage candidate. At least then I can go back to shouting from the highest tower that we should abolish the electoral college – but living in a world where Trump won the popular vote tells me America as a whole isn’t better than this, this is exactly who the majority of Americans are – hateful, scared and short sighted. I was lied to by my parents for my entire life – they told me there were more good people than bad people, but then they got old and they started voting for the very same bad people they taught me how to recognize. What the everloving fuck happened
