      To implement the provisions of laws such as the Constitution, the Civil Code, and the Employment Promotion Law, and to effectively safeguard citizens’ personal dignity against infringement, the Supreme People’s Court hereby clarifies the following adjudication rules:

      First, regarding cases involving the public insult or defamation of an individual’s sexual orientation, gender identity, or gender expression, people’s courts generally deem such acts to constitute an infringement of general personality rights; they order the cessation of the infringement, a formal apology, and compensation for emotional distress, thereby explicitly establishing the illegality of discriminatory speech and conduct based on sexual orientation, gender identity, or gender expression.

      Second, in the contexts of recruitment, hiring, job reassignment, or dismissal, should an employer engage in differential treatment on the grounds of sexual orientation, gender identity, or gender expression, people’s courts shall, in accordance with the law, determine that the employer has committed employment discrimination; they shall order the revocation of the relevant decisions, compensation for losses, and other remedies, thereby explicitly prohibiting unreasonable discrimination based on sexual orientation, gender identity, or gender expression within the sphere of employment.

      Third, should a school impose inappropriate disciplinary measures against students—or fail to fulfill its administrative duties, thereby leading to campus bullying—on the grounds of the students’ sexual orientation, gender identity, or gender expression, people’s courts shall, in accordance with the law, hold the school liable, thereby reinforcing schools’ obligation to protect students’ personal liberty and dignity. These cases collectively demonstrate the people’s courts’ unequivocal stance: that the legitimate rights and interests of sexual minorities are entitled to equal protection under the law, and that any unreasonable discrimination based on sexual orientation, gender identity, or gender expression is strictly prohibited by law.

      Moving forward, we will continue to systematically review cases nationwide involving the protection of sexual minorities’ rights and interests, summarize adjudication rules, and standardize adjudication criteria. At appropriate junctures, we will formalize established adjudication rules through various mechanisms—such as judicial interpretations, conference minutes, guiding cases, reference cases, and exemplary cases—to enhance the provision of legal norms.       China has a fair way to go to reach more socially progressive countries like Cuba, but the state does not categorize LGBTQIA+ individuals as “obscene” or “vulgar,” and instead has protections against discrimination based on gender and sexuality.

      No it’s not. Porn is treated as vulgar. Romance and Gay Romance is legal. China had legal gay marriage before the US. So has Cuba.

      you think that’s such a big gotcha. Most people in China use their own fuckin websites dude. You can go to metal shows where they show graphics of pigs being slaughtered in China, where they show gay stuff, it doesn’t matter. You can also do that stuff in USA as long as where you do it won’t be so offended they shut you down.

      I live in a very liberal city in USA and I love metal so I see crazy edgy shit like that at shows all the time, I’ve come to learn it’s not only legal in China but it works pretty much the same way, the worse “censorship” you’d get is you might have to write a fake band name in your request to play, and I’ve known people who have done that in USA since the 80s to be able to play gigs. If you guys read a little more and go outside for once you’d see the world isn’t as scary as your online hug box tells you it is

          It’s legal, not recognized. I’d bet money it’ll be accepted on the mainland before it is in US. Same with trans surgeries. Now you’re blocked, go spread this nonsense on the internet everywhere :)

        You can use sites to check if they are banned by China’s great wall. Lemmy.ml…blocked. if the Chinese leadership decided to crack down on vpn they could. Up to the whim of a single guy without any recourse. I guess that’s ok for some.

          So is lying all you do? It’s not up to one person. Also the fact it COULD be completely banned by the government is not scary, any government could ban ANYTHING. And it’s never just one persons decision. You clearly don’t read or know how shit works. Take a civics class for fucks sake… oh wait, we’re westerners so it costs too much.
